The Regulations on access to collections

Chapter I – GENERAL PROVISIONS

§1

The library collection is available:

1. in reading rooms,

2. by lending outside the Library,

3. through interlibrary lending,

4. through a computer network in case of electronic collections.

§2

The right to use the services of the Library have:

1. employees and students of the Faculty of Law, Administration and Economics:

a) students with a confirmed disability have the right to individual conditions of using the Library’s collections, the provision of which is regulated by these Regulations;

b)other individual readers who are purchased an annual, semi-annual, monthly or weekly library card to the main Reading RoomThe fee for the card is determined by the Dean at the request of the Library Commission;

2. libraries entitled to interlibrary loans.

§3

The users of the Library’s collections and catalogs are obliged to take care of library materials and the library equipment. They are responsible for any losses and deficiencies caused by them. In order to avoid responsibility for already existing damage, the reader is obliged to report any noticed defects to the librarian on duty.

§4

The Library Director may refuse to provide the reader particularly valuable materials and materials in poor condition. In such cases particularly valuable materials are available in the form of reproductions, while materials in poor condition are available after their conservation.

§5

The working hours of the Library are communicated to the readers by posting the schedule on the Library’s website.

Readers are informed about each change in working hours by posting a separate notice on the Library’s website.

§6

1. In accordance with the copyright law, the Library provides payable reprographic services. Reading rooms accept orders placed on the appropriate form for photocopies of pre-war literature and works brought in asan interlibrary loan.

2. Reprographic services are paid according to the current price list. The price list is prepared by the Director and approved by the Dean, after approval of the Library Commission.

 

Chapter II –THE READING ROOMS

 

 1. GENERAL PROVISION

§7

1. The services ofthe Reading Rooms are available to adults, including high school students – after obtaining permission from the Library Director.

2. In order to use the Reading Rooms, the reader must have a valid student card or employee ID card, and for people outside the University of Wroclaw – a valid library card to the Reading Room.

3. The right to place an order for books via computer is acquired by readers upon obtaining a library card or upon activating the library account on the basis of student card.

4. The reader places an order:

a) via computer – for the library materials that are in the computer catalog,

b) in traditional way (a paper call slip) – for library materials not developed by computer. 

§8

The users of the Reading Roomsshall:

1. Leave in lockers outerwear, briefcases, bags, handbags, backpacks, laptop covers etc.

2. Sign into the book of visits and leave at the librarian on duty a document entitling to use the Reading Rooms;

3. Be silent;

4. Not bring food and drink, not smoke;

5. Obtain permission from the librarian on duty to use private electronic equipment;

6. Obtain permission from the librarian on duty to take pictures with their own camera without using a flash;

7. Not make phone calls in the Reading Rooms;

8. Not copy unpublished doctoral theses;

9. Comply with the Copyright Act.

§9

Librarians on duty in the Reading Roomsare obliged to check, in the presence of the reader, the condition of available collections, with particular emphasis on the completeness of the works – before they are used, and when they are returned.

§10

Bringing library materials out of the Reading Rooms is not allowed.

§11

The reader can use their own materials, after writing them down and giving the list to the librarian on duty. Before leaving the Reading Room the user is obliged to show these materials to the librarian.

§12

1. Collections in the Reading Rooms can only be used on site.

2. Library materials located outside the Reading Rooms should be ordered by computer or on traditional call slips filled by penCall slips filled by pencil, inaccurately or illegibly will not be realized.

3. In the Reading Roomslibrary materials are also available in the form of reproductions.Valuable library materials are available only with the consent of the Library Director.

 

2. MAIN READING ROOM

§13

The main Reading Room (hereinafter referred to as the Reading Room) provides access to library materials:

1. available in the Reading Room,

2. from the Library’s storage,

3. brought from other libraries through interlibrary loans.

§14

1. The use of the Reading Room’collection is on the principle of free access to shelves. After using the library materials, the reader does not put them on the shelves, but puts them on trolleys and tables intended for this purpose.

2. The sought-after publications, valuable and non-binding magazines are separated and made available by the librarian on duty.

§15

1. Computer orders and traditional call slips for library materials located in the storage are carried out on weekdays during storage working hours. Orders placed after working hours are realized on the next day. Orders placed on Saturdays after working hours are realized on Monday.

2. Orders are delivered to the Reading Room every 30 minutes. During periods of intensive reader traffic, the realization time may be extended.

§16

Books ordered to the Reading Room can be booked for up to 2 weeks at the reader’s request. Library materials not used within 4 days are sent back to the storage.

§17

The reader can order 5 volumes of books or magazines at a time.

§18

In the Reading Room, there is a stand for students with a recognized disability adapted to the visually impaired.

§19

After finishing work in the Reading Room, before leaving it, the reader is obliged to give back to the on-duty librarian all library materials that he or she used in an unchanged condition. After that, the librarian gives the reader the identity document.

§20

In the Reading Room, there are computer stations intended for using databases purchased by the Library.

§21

1. Employees and students of the Faculty of Law, Administration and Economics are authorized to use the library computer stations on their own.

2. After logging in, the users can also use their own laptops – via the Faculty’s wireless Internet network – and use electronic databases and licensed online services.

§22

Readers may use computers only for their intended purpose, i.e. for research and educational purposes. They may not be used for games and plays.

§23

It is forbidden to use computers for commercial purposes, to perform any activities that infringe the copyrights of the developers or distributors of software and databases.

§24

1. The readers, with the consent of the librarian on duty, may use their own electronic media (e.g. removable memories), however, they are obliged to report this fact to the librarian and give him or her the media to scan for the presence of malicious software. It is forbidden to install own electronic media.

2. The reader uses private electronic equipment at their own responsibility.

3. The Library is not responsible for any damage to the user’s equipment or loss of data belonging to the reader.

4. The Library is not responsible for electronic equipment left unattended.

5. The reader is responsible for possible damage or causing a malfunction of electronic equipment belonging to the Library.

§25

Only installed programs may be used. Installation of other programs and changes to existing ones is not allowed.

§26

In case of violation of the rules in force, the librarian on duty has the right to terminate the user session immediately.

§27

Any damage or malfunction of computers should be reported immediately to the librarian on duty.

§28

1. For employees and students of the Faculty of Law, Administration and Economics, access to electronic databases of licensed online services is free of charge. Other users should pay a fee according to the current price list. The price list is prepared by the Director and approved by the Dean, after approval by the Library Commission.

2. The rules of using the databases licensed outside the network of the Faculty are defined by the license terms and regulations of the Library.

3. Students of the Faculty with a stated disability have the possibility to obtain the right to use licensed electronic resources outside the network of the University of WrocÅ‚aw on the same rights as employees and doctoral students.

§29

Computer printouts are charged according to the current price list, which is prepared by the Director and approved by the Dean, after approval by the Library Commission.

 

3. SCIENTIFIC READING ROOM

§30

The Scientific Reading Room is open to employees and doctoral students of the Faculty.

§31

In this Reading Room, there are foreign magazines and encyclopedias. The user can also use the main Reading Room’collections and materials brought from the storage.

 

4. COMPUTER READING ROOM AND CURRENT PERIODICAL READING ROOM

§32

1. The Reading Room is designed to obtain intellectual information, especially scientific information, within the University itself and through connections to other networks.

2. The Reading Room is not a public facility. Its services may be used only by employees, doctoral students, and students of the Faculty within the scope of their scientific, didactic and administrative duties. Employees and students of other universities who are doing internships and apprenticeships at the Faculty may use the Reading Room only in case of vacancy of computer stations. The availability of computer stations is determined each time by the librarian on duty.

4. Access to electronic databases and licensed online services for Faculty students and employees is free of charge.

§33

Text and bibliographic databases, and the Internet are available in the Reading Room.

§34

The reader, after finishing work in the Reading Room, is obliged to give back to the on-duty librarian all the materials in unchanged condition.

§35

1. Computers in the Reading Room may be used only for research or educational works. They cannot be used for commercial or entertainment activities.

2. The computer station is designed to obtain information from the databases provided by the Reading Room, and from the Internet; private use is not permitted.

3. The gatheringof collections, transfer of files or other resources to the computer disk, library server or other server, use of social networking sites or similar activities is allowed only if it is necessary for research purposes.  

4. In cases of disputes, the librarian may require confirmation of the necessity,referred to in point. 3by the supervisor or the teacher in charge.

§36

1. Installation or uninstallation of any software, including deleting files at the computer, is not allowed.

2. Software available in the Computer Reading Room is subject to copyright law and license restrictions. It may not be copied or used for non-academic purposes.

3. The user of the Reading Room may request a printout of information obtained by him or her from databases. The printout is the only method of transferring information; it is not allowed to copy files to external data carriers.

4. Printing the information referred to in point 3 is chargeable. The price list is available at the post of the librarian on duty.

§37

It is forbidden to install own electronic media.

§38

1. Reading Room users are obliged to comply with the law, the Regulations of the Library of the Faculty of Law, Administration and Economics of the University of WrocÅ‚aw, and the principles of ethics, in particular by refraining from taking any actions that would infringe personal rights of other people or expose them to moral or material losses.

2. Persons who violate above rules and other provisions of these Regulations may be subject to proceedings resulting from appropriate disciplinary or other liability provisions.

§39

1. Persons using the Reading Room are obliged to behave properly, i.e. to maintain silence, not to carry in luggage, to leave their outerwear in the lockers etc. Bringing meals or drinks to the Reading Room is not allowed.

2. Each user of the Reading Room need to be registered before starting work at the duty librarian. Registration is done by signing in the book of visits and giving a valid student ID card, library card or IDto the librarian. The workstation (seat) is assigned by the librarian.

3. It is not allowed for users to switch on or off the Reading Room facilities by themselves.

4. Any malfunction or equipment failure should be immediately reported to the duty librarian.

§40

In case of violation of the rules in force, the librarian on duty has the right to terminate the user session immediately.

§41

The librarian is available to help with the installed databases.

§42

Some of the stations in the Computer Reading Room are intended for readers of current journalsIn the Reading Room, there are:

1. current national journals,

2. current foreign journals,

3. library materials from the main Reading Room’s collection.

§43

The reader receives journals and books from the mainReading Room’s collection from the librarian on duty, after filling the call slip. 

§44

After finishing work in the Computer Reading Room, before leaving it, the reader is obliged to give back to the on-duty librarian all library materials that he or she used in an unchanged condition. After that, the librarian gives the reader the identity document.

§45

In other matters, the General Provisions and Regulations of the main Reading Room apply.

§46

The functioning of the Reading Room is supervised by the Library Director of the Faculty of Law, Administration and Economics.

 

Chapter III – LOCAL LENDING 

§47

The Local Lending Department lends library materials outside the Library for students, doctoral students and employees of the Faculty of Law, Administration and Economics.

§48

1. The right to borrow books is obtained by activating the library account on the basis of an electronic student ID card or library card in the Faculty library or University Library. The basis for receiving a library card or activating a library account is:

a) for Faculty employees, also retired – an identity card;

b) for students and doctoral students of the Faculty, who have an electronic course of study student obligation card”, identity card and student ID card;

c) for doctoral students in the extramural system, scholarship holders and interns of the Faculty, who are not Polish citizens, temporarily residing in WrocÅ‚aw – Dean’s application or a letter of the doctoral thesis supervisorand an identity card,

d) foreigners – students of the Faculty –student obligation card”, identity card (passport) and student ID card.

2. The fees for the library card is determined by the Director of the University Library.

§49

The library card is valid for a given academic year. It can be prolonged to the next academic year after the settlement of loans from the previous academic year and showing of the following documents:

1. for students and doctoral students – a valid student card,

2. for doctoral students, scholarship holders and interns of the Faculty – a renewed application from the Dean or a letter from the doctoral thesis supervisor, and an identity card,

3. for the employees of the Faculty – an identity card.

§50

The right to borrow cannot be passed on to another person. Failure to comply with this provision will result in the removal of the cardholder’s library account and a ban on using the University Library’s collection.

§51

1. A student with a disability has the right to appoint an attorney to borrowprolong, and return books.

2. The attorney of the disabled student shall present the power of attorney, according to the specimen specified in Attachment PeÅ‚nomocnictwo to these Regulations, with a signature certified by an employee of the local Lending Department.

3. The power of attorney, referred to in point 2, is extended for another academic year together with a library card renewal.

§52

In justified random cases, the user may appoint an attorney for borrowing and prolonging books. The provisions of §51 point 2 shall apply accordingly.

§53

The user is obliged to immediately inform the local Lending Department about any changes of personal and contact details.

§54

The library account extension can be made in the local Lending Department or in the University Library Lending Department.

§55

1. In case of losing the library card, one should immediately notify the local Library Lending Department or the University Library Lending DepartmentDamage caused by the failure to do so will be charged to the cardholder.

2. The reader can receive a duplicate of the library card at the University Library after returning all borrowed books, submitting the appropriate documents (as in the case of enrolling in the University Library) and paying for a new card.

§56

Loss of the right to borrow is effected:

1. after the library card expires;

2. at the request of the reader, after the liabilities to the Library have been settled;

3. the decision of the University Library Director or the Faculty Library Director, e.g. in the case of persistent violation of the Regulations of the University Library and the Faculty Library Regulations.

§57

1. Orders to the local Lending Department are placed on call slips containing data of the borrower (without the address of residence) and the data of the ordered book. The reader places an order in two ways:

a) in the computer catalog database, the reader fills in the computer call slip for the available title; when receiving the book in the local Lending Roomthe reader signs the computer call slip;

b) for non-computerized books the reader fills the traditional papercall slip.

2. The call slip is a proof of the conclusion of a lending agreement in accordance with Articles 710-719 of the Civil Code. The return of the call slip takes place at the moment of handing over the borrowed library materials or after the Library’s claims for compensation have been satisfied or after the regulation penalty has been settled.

§58

1. Readers receive their books in the local Lending Room after submitting a valid library card for the current academic year.

2. Books not picked up within 4 days from the date of order placement are sent back to the storage. Orders that are not realized are returned to the reader with an annotation about the reasons for not delivering the ordered books.

§59

1. The library lends materials to:

a) professors and other academic teachers of the Faculty – max. 20 volumes for a period not longer than 180 days, with the obligation to settle account by the end of an academic year. In justified cases, it is possible to lend more volumes necessary for scientific and didactic work;

b) Faculty staff who are not academic teachers – max. 10 volumes for a period not longer than 90 days, with the obligation to settle account by the end of an academic year;

c) Students of five-year full-time studies, part-time studies1–3 year of studies, and postgraduate students of the Faculty, undergraduate students of the above mentioned mode of study 1–2 year of studies – 5 volumes for a period not longer than 90 days, with the obligation to settle account by the end of an academic year;

d) students of five-year full-time studies, part-time studies of the 4th and 5th year, students of complementary master studies and students of the 3rd year of bachelor degree studies – 7 volumes for a period not longer than 90 days, with the obligation to settle account by the end of an academic year;

e) doctoral students –10 volumes for a period not longer than 90 days, with the obligation to settle account by the end of an academic year;

f) students of two or more faculties at the Faculty of Law, Administration and Economics – 10 volumes for a period not longer than 90 days, with the obligation to settle account by the end of an academic year;

g) students with a confirmed disability – 10 books for a period not longer than 180 days, with an obligation to settle account by the end of an academic year.

2. In justified cases, the Library has the right to lend books for a shorter period of time or demand their return before the expiry of the deadlines specified in points a)–g).

3. The reader may obtain an extension of the deadline after presenting a valid library card in the Lending Room. Readers mentioned in point a) can prolong the borrowed book once for 180 days. The readers listed in points b)–g) can prolong the borrowed book once for a period of 90 days.

§60

1. In caseof failure to meet the deadlinespecified in §61 points 1–7 for returning borrowed library materials, the Library may apply the following sanctions:

a) blocking the reader’s account and sending an individual reminder to the reader’s e-mail address;

b) final call – a registered letter calling the reader to return the library materials within a strict deadline under pain of referring the case to a debt collection company.

2. For failure to meet the deadline for returning borrowed library materials, the Library has the right to charge fines. The amount of the penalty is determined by the Faculty Dean in consultation with the Library Commission and the Library Director.

§61

1. The borrowed library materials are entrusted to the care of the reader, who should check their condition in the presence of the librarian and report possible defects (underlings, annotations, mechanical damage, etc.). The reader is responsible for any damage undisclosed at the time of receipt of library materials, and found at their return.

2. It is the responsibility of the staff on duty in the Lending Room to check in the presence of the reader the state of preservation of the materials, with particular emphasis on the completeness of the works – before lending them to the reader and when returning them.

§62

In case of loss or damage the borrowed work, the reader is obliged to repurchase it in the same edition and make the binding, if the work had such a binder. In addition, there is a fee connected with the computer development of the work, the cost of code stripes, supralibrosand preservation of the work in the amount determined by the Dean of the Faculty in consultation with the Library Commission and the Library Director.

§63

If it is not possible to repurchase the work, the Library determines how to settle the reader’s obligations in one of the mentioned forms:

1. repurchase the work in another edition;

2. repurchase another work indicated by the Library, at a price which is a multiple (according to the valid valuation instruction) of the inventory price of the lost or destroyed work;

3. In addition, there is a fee connected with the computer development of the work, the cost of code stripes, supralibrosand preservation of the work in the amount determined by the Dean of the Faculty in consultation with the Library Commission and the Library Director.

§64

If a volume from a multi-volume work is lost and it is impossible to repurchase the work in the same edition, the reader should provide the whole of the multi-volume edition in a newer edition.

§65

1. The library does not lend:

a) special collections,

b) books published before 1950,

c) encyclopedic, dictionary, bibliographic and other information publications,

d) rare works of art, works difficult to buy, works with a large number of tables or maps or engravings,  

e) newspapers and magazines,

f) books in a bad state of preservation,

g) books from the book collections in the Reading Room,

h) books marked with the stamp “available on site” (“dostÄ™pnenamiejscu”),

2. In justified cases, the works mentioned points b), c), h) can be borrowed with the consent of the Library Director.

§66

1. Removal of the reader’s account takes place after the payment of the debts to the Faculty Library and University Library, and noting this fact by the Lending Department on:

a) an obligation cardissued by Employees’ Matters Department (DziaÅ‚SprawPracowniczych) – in case of the Faculty staff;

b) student obligation card issued by the Faculty Dean’s Office – in case of students (undergraduate and graduate studies, full-time, part-time, postgraduate and doctoral studies).

2. Electronic user account at the moment of settlement with the Faculty Library and the University Library will be completely removed from the database. In case of undertaking the second-cycle studies, the student should enroll in the Library again.

 

Chapter IV INTERLIBRARY LENDING

§67

Interlibrary lending provides library materials from national libraries for employees, doctoral students and students. To order library materials,one must have a valid library account.

§68

1. National interlibrary lending is conducted by the Interlibrary Lending Department of the Faculty Library.

2. International interlibrary lending is conducted by the Interlibrary Lending Department of the University Library.

3. Interlibrary loans are made on a reciprocal basis.

§69

The Interlibrary Lending Department lends its collections to the following institutions:

1. scientific, national libraries;

2. libraries of the chief authorities and state administration;

3. regional and municipal public libraries;

4. the pedagogical, regional libraries;

5. professional libraries in WrocÅ‚aw – for business purposes, according to the profile of the institution’s activity.

§70

The condition of accepting the order by the Interlibrary Lending Deoartament is the confirmation of the lack of the desired work in Wrocław's libraries.

§ 71

1. The order for importing a work from the national library is placed electronically or in person in a Lending Department, filling in the appropriate call slip carefully and legibly.

2. The basis for interlibrary loans is the call slip with the library stamp and the signature of a person authorized to conduct interlibrary loans in a given library.

3. The Library also provides interlibrary loans on orders sent by e-mail from libraries with which it has concluded appropriate agreements.

§72

1. The reader will be informed by e-mail or phone by the Interlibrary Lending Department about the arrival of the ordered work and the date of its return.

2. Library materials brought in through interlibrary lending are made available only in the main Reading Room for a period specified by the Lending Department (no longer than 3 weeks).

3. In justified cases, the reader may apply for an extension of the deadline for returning a work by reporting it to the Interlibrary Lending Department, not later than one week before the deadline.

§73

1. Importing books and document reproductions from national libraries requiring a fee is done at the expense of the reader.

2. The costs of reproductions sent by the national libraries, instead of the originals, are also charged to the reader, even though they were not ordered by the reader.

3. The reader, placing an order in the Interlibrary Lending Department, fills in and signs an appropriate statement in which he or she undertakes to cover the costs connected with the realization of the order according to the invoice presented by the lending Library.

§74

1. Interlibrary Lending Department lends library materials to other national libraries for a period:

a) one month –for books,

b) two weeks – for magazines.

2. In justified cases, the Interlibrary Lending Department may set a different period of time of using the library materials.

§75

Interlibrary Lending Department does not lend:

1. encyclopedic, dictionary, bibliographic and other information publications,

2. unpublished doctoral theses,

3. rare works, difficult to buy,

4. works in a bad state of preservation,

5. works available in the Reading Rooms’ collections,

6. works published before 1950.

§76

Orders that were not realized:

1. are sent back to the ordering library with the reason for not realizing the order, or

2. are sent to other relevant libraries for realizing.

§77

Ordered library materials are sent to other libraries via post or received by an authorized person. The person picking up the materials in the Interlibrary Lending Department should submit:

1. the call slip with the seal of the ordering library and the signature of a person authorized to interlibrary loans. The person authorized to sign the call slip is responsible for the lending materials, their condition and the timely return;

2. the identity document with written authorization from the ordering library.

§78

The Library or institution ordering library materials is obliged to secure them fully, return them within a specified period of time, and is materially responsible for their damage or loss.

§79

In case of violation these Regulations, the lending library loses the right to use the Library’s collections for the time determined by the Library Director.

 

Chapter V – REPROGRAPHIC SERVICES

§80

The Library makes scans of library materials published before 1950 from its own collections.

§81

Reprographic services are charged according to the current price list.

§82

The price list is prepared by the Director and approved by the Dean, after approval it by the Library Commission.

 

Chapter VI – SCIENTIFIC INFORMATION 

§83

1. The Library provides information about catalogues and bibliography based on its own collections, as well as mediates in obtaining information from other libraries and research centers.

2. The Library’s information system may include:

a) current, specialist information book collection,

b) specialist databases,

c) database of addresses of specialized libraries and research centers in Poland and abroad, according to the area of interests of the Faculty,

d) other databases and files necessary to conduct current information activities.

3. The duties of the Library include conducting classes in library training and scientific information for students of the Faculty of Law, Administrations and Economics.

 

Chapter VII – FINAL PROVISIONS

§84

The librarian has the right to refuse to serve a user who, by his or her behavior, infringes the provisions of the Regulations or infringes generally accepted standards of social coexistence.

§85

Complaints about the activities of the librarians on duty are received by the Library Director of the Faculty of Law, Administration and Economics or the Deputy Director.

§86

In matters not regulated in these Regulations, general provisions and regulations of the main Reading Room shall apply.

§87

The provisions of the Regulations may be amended in accordance with the procedure in force at its adoption.

§88

These Regulations were reviewed by the Director of the University Library and approved by the Dean of the Faculty of Law, Administration and Economics on 20.11.2018.

§89

The Regulations shall enter into force on 1 December 2018.
